The Canadian court’s conception of comity ignores the state as a site of contestation, where social movements disagree with the dominant development narrative of the state. In the Pacific Rim case, for example, the support of the El Salvadorian government was only achieved after years of lobbying on the part of church groups, local women’s organisations, environmental groups and others (MiningWatch 2014a) The moratorium on mining further had the support of international groups, which continue to offer their support by publically protesting the conduct of Oceania Gold in pursuing the government of El Salvador through ICSID (MiningWatch 2014b). The involvement of transnational advocacy movements (Keck, M. and Sikkink, K. 1998) can be seen throughout the litigation process in earlier cases raised, such as the cases against Anvil Mining and Cambior Inc. in bringing these actions to Canada, there is significant involvement, both financially and from a human resource perspective, from Canadian and transnational non-governmental organisations.

China is surrounded by several tectonic faults in the southeast seas, not only facing the threat of local tsunami, but also affected by regional and distant tsunami. The Pacific Rim region is a major global earthquake and tsunami region, known as the Ring of Fire (Suppasri et al. 2012). The Manila Trench, the Nankai Trouth and the Ryukyu Trench are the internationally recognized potential tsunami source. The tsunami caused by them pose a great threat to the coastal areas of China. The local tsunami and regional tsunami from the western North Pacific can reach the coast of China in a very short time, sometimes only a few hours. These tsunamis often cause serious damage because of the short response time.
